These Terms of Service (“Terms”) govern your access to and use of the Miivvandi website, online store, membership community, editorial content, digital resources, products, and related offerings (collectively, the “Services”).

The Services are operated by Miivvandi LLC (“Miivvandi,” “we,” “us,” or “our”) and are hosted through Shopify.

By visiting our website, creating an account, making a purchase, downloading a resource, placing a preorder, joining the Miivvandi Community, or otherwise using the Services, you agree to these Terms and our Privacy, Refund, and Shipping and Delivery Policies.

If you do not agree to these Terms, do not use the Services.

1. Eligibility and Account Responsibility

You must be at least the age of majority in your jurisdiction to make a purchase, create an account, or join a paid membership unless a parent or legal guardian completes the transaction and accepts responsibility.

You are responsible for:

  • Providing accurate and current information

  • Protecting your login credentials

  • All activity conducted through your account

  • Promptly notifying us of suspected unauthorized access

You may not use another person’s account or impersonate another person or organization.

2. Products, Services, and Availability

Miivvandi may offer:

  • Physical apparel and lifestyle products

  • Books and book preorders

  • Digital guides, ebooks, and downloadable resources

  • Community memberships

  • Educational content and conversations

  • Workshops, events, or other experiences

  • Made-to-order and print-on-demand merchandise

Product descriptions, images, prices, availability, release dates, and other information are provided in good faith. We make reasonable efforts to present information accurately, but minor differences in color, appearance, formatting, packaging, or display may occur.

We may update, limit, discontinue, or modify any product, service, feature, or offering at any time, subject to applicable law and obligations concerning completed purchases.

3. Orders and Payments

By placing an order, you represent that:

  • The information you provide is accurate

  • You are authorized to use the selected payment method

  • You agree to pay all applicable charges, taxes, shipping costs, and fees shown during checkout

Submitting an order does not guarantee acceptance. We may decline or cancel an order because of product availability, suspected fraud, pricing or listing errors, payment problems, legal restrictions, or other legitimate business reasons.

If we cancel a paid order, we will issue an appropriate refund.

4. Pricing and Promotions

Prices may change without notice, but a price change will not affect an order already accepted unless an obvious error occurred.

Discounts, promotional offers, and coupon codes:

  • May be limited by time, product, customer, or quantity

  • May not be combined unless expressly stated

  • Have no cash value

  • May be changed or discontinued as permitted by law

5. Digital Products and Limited License

Digital guides, ebooks, downloads, videos, worksheets, and other electronic resources are licensed—not sold—for personal, non-commercial use.

Purchasing a digital product does not transfer ownership of the content or any intellectual-property rights.

Unless Miivvandi provides written permission, you may not:

  • Copy or reproduce a digital product for distribution

  • Share download links or files with others

  • Resell, sublicense, publish, or commercially exploit the content

  • Upload the content to another website, platform, shared drive, artificial-intelligence system, or file-sharing service

  • Remove copyright, trademark, attribution, or proprietary notices

  • Create derivative products substantially based on Miivvandi content

Unauthorized use may result in termination of access and further action available under applicable law.

Digital products are subject to the Refund Policy.

6. Preorders

A preorder reserves a product expected to be released or fulfilled at a later date.

Estimated release, delivery, and shipping dates are provided in good faith but may change because of editing, printing, production, vendor, carrier, technology, or other fulfillment circumstances.

If a significant delay occurs, we will provide notice and any options required by applicable law.

Preorder cancellation and refund eligibility are governed by the Refund Policy. Physical preorders become subject to the physical-product terms after shipment. Complete digital preorders become subject to the digital-product terms after electronic delivery.

7. Community Memberships and Recurring Billing

Miivvandi Community memberships may renew automatically at the price and billing frequency disclosed during purchase.

By purchasing a recurring membership, you authorize the applicable payment provider to charge your selected payment method at each renewal until the membership is canceled.

You may cancel future renewals through the available account or membership controls or by contacting support@miivvandi.com.

Unless otherwise stated:

  • Cancellation stops future billing

  • Access continues through the end of the current paid billing period

  • Membership fees are non-refundable once access begins, except when required by law

  • Failure to participate does not create eligibility for a refund

  • Membership access may not be transferred or shared

Miivvandi may change membership features or future pricing by providing any notice required by applicable law. A pricing change will apply only as permitted under the applicable subscription terms and law.

8. Community Standards

The Miivvandi Community is intended to be a trusted environment for learning, thoughtful conversation, shared resources, accountability, and personal growth.

Participants must:

  • Communicate respectfully

  • Respect personal boundaries and differences

  • Protect other members’ privacy

  • Use community resources lawfully

  • Avoid harassment, discrimination, threats, intimidation, or abusive behavior

  • Avoid unsolicited advertising, promotion, recruiting, or repeated sales activity

  • Avoid knowingly false, misleading, illegal, or harmful content

  • Avoid recording, copying, photographing, or redistributing private community conversations without permission

Miivvandi may moderate content and suspend or terminate access when conduct violates these Terms, creates risk, disrupts the community, or threatens the safety, privacy, or rights of others.

Miivvandi cannot guarantee that every participant will maintain confidentiality. Members should use care when deciding what personal information to share.

9. Educational, Wellness, Financial, and Professional Disclaimer

Miivvandi content, products, resources, community conversations, and events are provided for general educational and informational purposes.

They are not a substitute for individualized:

  • Medical or nutritional care

  • Mental-health treatment

  • Legal advice

  • Financial, tax, investment, or securities advice

  • Professional diagnosis or treatment

  • Emergency services

Miivvandi does not diagnose, treat, cure, or prevent medical or mental-health conditions. Always consult an appropriately qualified professional regarding decisions involving your health, finances, legal rights, or other circumstances requiring specialized expertise.

Nothing shared through Miivvandi creates a doctor-patient, therapist-client, attorney-client, financial-adviser, fiduciary, or similar professional relationship.

If you are experiencing an emergency or believe you may be in danger, contact the appropriate emergency service or qualified professional immediately.

10. Coaching and Individual Services

Purchasing a product, membership, or digital resource does not include private coaching, consulting, advocacy, or individualized services unless expressly stated in a separate written offer or agreement.

Any separately requested coaching or advocacy service may require an additional written agreement, informed consent, disclaimer, scope of service, and payment terms.

11. No Guaranteed Outcomes

Personal growth, wellness, business, financial, and lifestyle outcomes vary between individuals.

Miivvandi does not guarantee:

  • Specific personal or professional results

  • Income, business growth, investment returns, or financial outcomes

  • Health, wellness, or lifestyle outcomes

  • Employment, partnership, publishing, or other opportunities

  • That any particular strategy or resource will be appropriate for every person

You remain responsible for evaluating information and making your own decisions.

12. Intellectual Property

The Services and their content—including text, articles, books, frameworks, downloads, graphics, designs, photographs, videos, logos, product names, course materials, and other original content—are owned by or licensed to Miivvandi LLC and are protected by applicable intellectual-property laws.

This includes, without limitation, Miivvandi branding and original materials associated with:

  • Miivvandi

  • Miivvandi Publishing

  • The 3M Method™

  • Mindset • Movement • Momentum

  • Say Yes 2 Wellness™

  • Give Better. Live Better.

  • Better lives are built.

Nothing in these Terms transfers ownership or grants a license beyond the limited personal-use rights expressly provided.

You may share ordinary links to publicly available Miivvandi webpages. You may not reproduce, republish, sell, distribute, or commercially exploit Miivvandi content without prior written permission.

13. User Content and Submissions

If you submit a review, comment, community post, photograph, testimonial, suggestion, or other content, you retain ownership of your original content.

You grant Miivvandi a limited, non-exclusive license to host, store, display, and process that content only as reasonably necessary to operate, moderate, and provide the applicable Service.

Miivvandi will not use a private community statement as a public testimonial or marketing endorsement without permission.

You represent that:

  • You own or have permission to submit the content

  • The content does not violate another person’s rights

  • The content is not unlawful, defamatory, deceptive, abusive, or malicious

  • The content does not contain unauthorized confidential information

We may remove content that violates these Terms or creates legal, security, privacy, or community concerns.

14. Prohibited Uses

You may not use the Services to:

  • Violate any law or regulation

  • Infringe intellectual-property, privacy, publicity, or other rights

  • Transmit malware, harmful code, or disruptive technology

  • Attempt unauthorized access to accounts, systems, or data

  • Scrape, harvest, or collect information without permission

  • Commit fraud or misrepresent your identity

  • Harass, threaten, exploit, or harm another person

  • Circumvent purchase, access, download, or membership restrictions

  • Resell or redistribute products or content in violation of these Terms

  • Interfere with the operation or security of the Services

15. Third-Party Tools, Platforms, and Links

The Services may rely on or link to third-party platforms, including Shopify, payment processors, membership tools, digital-delivery services, shipping carriers, social networks, video-conferencing services, and other providers.

Third-party services are governed by their own terms and privacy policies. Miivvandi does not control and is not responsible for unaffiliated third-party websites, services, availability, security, or content.

16. Reviews and Feedback

Reviews and feedback must reflect genuine experiences and may not contain unlawful, abusive, misleading, or infringing material.

We may display, decline, or remove reviews as permitted by law and our platform rules. We do not promise to publish every submission.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as available” and “as is” basis.

Miivvandi does not guarantee that the Services will always be uninterrupted, error-free, secure, or compatible with every device or system.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Miivvandi LLC and its owners, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Services.

Where liability cannot be excluded, Miivvandi’s liability will be limited to the extent permitted by law.

These limitations do not apply where prohibited by law and do not restrict non-waivable consumer rights.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Miivvandi LLC from third-party claims, losses, liabilities, and reasonable expenses resulting from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.

20. Suspension and Termination

We may suspend, limit, or terminate access to the Services when reasonably necessary to:

  • Address a violation of these Terms

  • Protect the security or operation of the Services

  • Protect customers, members, Miivvandi, or third parties

  • Respond to fraud, abuse, unlawful conduct, or payment failure

  • Comply with legal obligations

Terms that by their nature should continue after termination—including intellectual-property, disclaimer, limitation-of-liability, and dispute provisions—will survive.

21. Privacy

Our collection and use of personal information are governed by the Miivvandi Privacy Policy.

22. Governing Law

These Terms are governed by the laws of the State of Maryland and applicable federal law, without regard to conflict-of-law principles.

Any dispute that is not resolved informally will be brought in a court with appropriate jurisdiction in Maryland, unless applicable consumer law requires otherwise.

23. Changes to These Terms

We may update these Terms to reflect changes to the Services, business practices, or legal requirements.

The revised Terms will be posted on the website with an updated date. Additional notice will be provided when required by law.

Continued use of the Services after updated Terms take effect constitutes acceptance to the extent permitted by law.

24. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

25. Entire Agreement

These Terms and the policies referenced within them constitute the agreement between you and Miivvandi concerning the Services, except where a separate written agreement applies to a particular service.
